Terms of Service

These Terms and Conditions ("Terms") govern access to and use of Frejmwork (the "Service"), provided by Trädkungen Skåne AB ("we", "us", or "our"). By creating an account, accessing, or using the Service, you ("you" or "User") agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

1.1 Age requirement. The Service is available only to individuals who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.

1.2 The Service is not directed at, and must not be used by, anyone under 18. We do not knowingly collect personal data from individuals under 18. If we become aware that an account belongs to a person under 18, we will suspend or terminate that account and delete the associated data as required by law.

1.3 We may implement age verification or attestation measures at signup or at any later time and may suspend accounts where we reasonably believe this eligibility requirement is not met.

1.4 By registering, you also confirm that you are not barred from using the Service under the laws of Sweden, the European Union, or your country of residence, and that you are not a person subject to applicable trade or economic sanctions.

2. The Service

2.1 Frejmwork is a project-planning application that uses artificial intelligence, including large language models provided by Anthropic, PBC ("Anthropic"), to help you plan, structure, and manage projects.

2.2 AI disclosure. Certain features rely on generative AI ("Claude", operated by Anthropic) to generate text, suggestions, breakdowns, or other outputs ("AI Outputs"). You are interacting with an automated system, not a human, when using these features.

2.3 AI Outputs are generated probabilistically and may be inaccurate, incomplete, outdated, or inappropriate for your purpose. AI Outputs do not constitute professional, legal, financial, or project-management advice. You are solely responsible for reviewing, verifying, and deciding whether to rely on or act upon any AI Output.

2.4 We may modify, suspend, or discontinue any part of the Service, including specific AI-powered features, at any time, with or without notice.

3. Accounts

3.1 You must provide accurate and complete information when creating an account and keep it up to date.

3.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@frejmwork.dev if you suspect unauthorized use.

3.3 You may not create an account on behalf of someone else without authorization, share your account with others, or maintain more than one account for abusive or circumventing purposes (e.g., to bypass usage limits).

4. Acceptable Use

4.1 You agree not to use the Service to:

• Violate any applicable law, regulation, or the rights of any third party;
• Submit prompts or content intended to generate illegal, sexually explicit, violent, hateful, harassing, or self-harm-related material;
• Attempt to bypass, disable, probe, or manipulate safety features, content filters, or usage limits (including prompt injection or "jailbreak" attempts directed at the underlying AI models);
• Extract, reverse-engineer, or attempt to derive the underlying model weights, system prompts, or training data of any AI model used by the Service;
• Use the Service to develop a competing product, or to train, fine-tune, or benchmark a separate machine learning model, except as expressly permitted;
• Use automated means (bots, scrapers) to access the Service outside of any API we officially provide;
• Misrepresent AI Outputs as human-generated content in a way intended to deceive;
• Upload malware, attempt to gain unauthorized access to our systems, or interfere with the integrity or performance of the Service;
• Resell, sublicense, or provide third-party access to the Service or its underlying AI capabilities without our written consent.

4.2 Your use of the Service must also comply with Anthropic's Usage Policy (available at anthropic.com/legal/aup), as it may be updated from time to time. A violation of Anthropic's Usage Policy is also a violation of these Terms.

4.3 We reserve the right to monitor usage patterns and content submitted to the Service (including prompts and outputs) for the purposes of abuse detection, safety, billing accuracy, and legal compliance, as further described in our Privacy Policy.

5. Credits, Fees, and Billing

5.1 Access to certain features requires purchase of a subscription plan and/or usage credits, as described on our pricing page. Prices are shown inclusive or exclusive of VAT as indicated at checkout.

5.2 Payments are processed by Stripe. By providing payment information, you authorize us to charge the applicable fees to your chosen payment method.

5.3 Credits and subscription allowances are non-transferable. Unused credits may expire as described on our pricing page. Once credits are exhausted, access to credit-consuming features will be blocked until you purchase additional credits or your allowance renews.

5.4 Right of withdrawal. If you are a consumer within the EU/EEA, you generally have a 14-day right of withdrawal from a distance contract. By purchasing credits or a subscription and requesting immediate access, you acknowledge that once digital content or a service has been fully or partially delivered/consumed, your right of withdrawal may be lost in accordance with applicable consumer protection law.

5.5 We may change our prices with prior notice. Price changes will not affect fees already charged for the then-current billing period.

5.6 You are responsible for any taxes applicable to your use of the Service, other than taxes based on our net income.

6. Intellectual Property

6.1 Our IP. The Service, including its software, design, trademarks, and content (excluding User Content and AI Outputs), is owned by Trädkungen Skåne AB or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you rights in our trademarks or branding.

6.2 Your content. You retain ownership of the content, data, and project information you submit to the Service ("User Content"). You grant us a limited, worldwide, non-exclusive license to host, process, and transmit User Content solely as necessary to operate and improve the Service, including sending it to our AI subprocessors (e.g., Anthropic) to generate AI Outputs.

6.3 AI Outputs. As between you and us, and subject to Anthropic's and any other applicable third-party terms, you may use AI Outputs generated for you through the Service for your own internal or business purposes. We make no claim of ownership over AI Outputs, but we do not guarantee that any AI Output is unique, free of third-party rights, or eligible for intellectual property protection.

6.4 You are responsible for ensuring that User Content you submit does not infringe the rights of any third party.

7. Third-Party Services

7.1 The Service relies on and integrates third-party providers, including but not limited to Anthropic and other AI model providers, Supabase, Vercel, Stripe, Upstash, Resend, and Sentry (collectively, "Subprocessors"). Their availability, performance, and terms may affect the Service.

7.2 We are not responsible for outages, errors, or changes in the underlying AI models or other third-party services that are outside our reasonable control, though we will make reasonable efforts to notify you of material changes affecting the Service.

8. Privacy

8.1 Our collection and use of personal data is described in our Privacy Policy, available at /privacy, which forms part of these Terms. We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Swedish law.

8.2 Prompts and content you submit may be transmitted to and processed by our AI Subprocessors in order to generate AI Outputs, in accordance with their data processing terms and our Privacy Policy.

9. Disclaimers

9.1 THE SERVICE, INCLUDING ALL AI OUTPUTS, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

9.2 We do not warrant that AI Outputs will be accurate, complete, reliable, or suitable for any particular project, decision, or purpose. You are solely responsible for independently verifying any AI Output before relying on it.

9.3 We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

10. Limitation of Liability

10.1 To the maximum extent permitted by applicable law, in no event shall we, our officers, employees, or subprocessors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service.

10.2 To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) SEK 1,000.

10.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Swedish or EU law, including liability for death, personal injury caused by negligence, fraud, or gross negligence.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

12. Suspension and Termination

12.1 We may suspend or terminate your account, in whole or in part, at any time if we reasonably believe you have violated these Terms, Anthropic's Usage Policy, or applicable law, or if required to do so by law or a Subprocessor.

12.2 You may terminate your account at any time by contacting us at hello@frejmwork.dev or through account settings. Fees already paid are non-refundable except as required by law or as otherwise stated in these Terms.

12.3 Sections that by their nature should survive termination (including Sections 6, 9, 10, 11, and 14) will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., by email or in-app notice) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

14.1 These Terms are governed by the laws of Sweden, without regard to its conflict-of-law principles.

14.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sweden, save that if you are a consumer, you may also bring proceedings in the courts of your country of residence within the EU, and mandatory consumer protection provisions of that country may apply.

14.3 The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr for consumers who wish to raise a complaint.

15. Administrator troubleshooting access

15.1 Authorized Frejmwork platform administrators may impersonate a user account to diagnose and resolve support issues. Impersonation is used for troubleshooting purposes only.

15.2 While impersonating your account, an administrator may view your data and perform actions on your behalf as if they were signed in as you, including creating, changing, or deleting content. Impersonation sessions are time-limited, clearly indicated to the administrator, and recorded in an audit log (including when impersonation starts and ends).

15.3 By using the Service, you acknowledge that this access may occur when necessary to investigate bugs, billing issues, or other problems you report, or when required to protect the integrity and security of the platform.

16. Miscellaneous

16.1 If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

16.2 Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right.

16.3 You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

16.4 These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trädkungen Skåne AB regarding the Service.
